TERMS OF USE – Booking Confirmation and Payment Interface (users)

1. WHO WE ARE AND WHAT THIS PAGE DOES
1.1 WeSpeak provides a conversational interface that allows you to confirm your booking and submit your payment information securely and privately, according to the flow selected by the Hotel.
1.2 WeSpeak is not a travel agency, proprietary gateway, or financial institution; it is not the Merchant of Record and does not make decisions regarding authorizations, refunds, chargebacks, or settlement timelines.
1.3 Payment and relationship with the Hotel. The payment you make binds you directly and exclusively to the Hotel (Merchant of Record). It is your responsibility to read the Hotel’s policies (rates, taxes, cancellations, no-show, refunds) available on its website; if you cannot find them, you must contact the Hotel directly before completing the payment.
2. DOCUMENTS YOU MUST READ/ACCEPT
By using this page, you declare that you have read and accept:

2.4 The Hotel’s policies (rates, cancellations, no-show, refunds).
3. PAYMENT ROLES
3.1 ZRU (independent third party entirely unrelated to WeSpeak): embedded component that captures your card details. Its service is governed by its own terms.
3.2 Hotel (Merchant of Record): receives your payment data (according to the configured flow) and processes the charge (manually/CNP or through its PSP). Sets prices and policies.
3.3 WeSpeak: only facilitates the interface/channel; does not charge, does not store full card data, and is not responsible for decisions made by the Hotel, ZRU, or PSP.
4. PAYMENT DATA AND PRIVACY
4.1 Your card details are entered into ZRU and may be made available to the Hotel so it can process the payment for the specific booking.
4.2 WeSpeak does not access or store your full card data.
4.3 You agree that ZRU/Hotel may transfer data outside your jurisdiction and disclose it when required by law, in accordance with their respective policies.
5. CONFIRMATION, CHANGES, CANCELLATIONS, AND REFUNDS
5.1 Your booking is confirmed by the Hotel.
5.2 Changes, cancellations, refunds, and chargebacks must be handled directly with the Hotel and/or its PSP, according to their policies. WeSpeak does not intervene in those decisions.
6. FEES, COMMISSIONS, AND CURRENCY
Fees, taxes, exchange rate differences, and PSP charges depend exclusively on the Hotel/PSP. WeSpeak does not set or collect these amounts.
7. SECURITY AND AVAILABILITY
7.1 WeSpeak applies reasonable security measures and depends on third-party services (e.g., WhatsApp, ZRU, PSP).
7.2 The interface is provided “as is” and “as available,” without guarantees of uninterrupted availability or results.
8. PERMITTED USE
You are required, and you agree, to: (i) provide truthful information; (ii) use this page only for a legitimate booking; (iii) not attempt to access or interfere with systems. You must be of legal age according to your local law.
9. LIABILITY
9.1 Independence. WeSpeak, the Hotel (Merchant of Record), and ZRU/PSP act as independent third parties; no mandate, agency, partnership, joint venture, franchise, or employment relationship exists between them. WeSpeak is not the Merchant of Record, not a payment gateway, not a collection agent, and does not hold funds.
9.2 No responsibility of WeSpeak. To the maximum extent permitted by law, WeSpeak is not liable for acts or omissions of the Hotel or ZRU/PSP (including authorizations, declines, captures, settlements, delays, refunds, chargebacks, fraud, third-party unavailability, Hotel price/policy errors, PCI/privacy compliance, and/or cross-border transfers), nor for the quality or delivery of the hotel service.
9.3 “As is / tal cual.” The Interface is provided “as is” and “as available,” with no guarantee of uninterrupted operation or results.
10. CHANGES TO THESE TERMS
WeSpeak may update these terms. The current version will always be the latest published on this page. Continued use implies acceptance.
11. CUSTOMER SUPPORT, PRIVACY, AND APPLICABLE LAW
11.1 Support and claims. For any question, complaint, change, cancellation, refund, chargeback, billing, rate, or policy related to your booking, you must contact the Hotel (Merchant of Record) directly. WeSpeak is not part of and does not resolve commercial booking issues.
11.2 Payments and payment methods (Hotel/ZRU). Questions about charges, chargebacks, settlement timelines, fees, or payment methods must be addressed to the Hotel. WeSpeak does not participate in authorization, capture, or settlement, does not hold funds, and is not the Merchant of Record.
11.3 Privacy and personal data.
11.3.1 Hotel (controller): for booking data and, when applicable, Cardholder Data, contact the Hotel according to its policies available on its website.
11.3.2 WeSpeak (processor): WeSpeak processes minimal operational data to operate the Interface and will forward any data request to the controller (Hotel). Technical contact: [info@wespeak.pro].
11.4 Consumer rights. Nothing above limits your non-waivable consumer rights under the applicable law of your country. You may contact your local consumer protection authority if you deem it necessary.
11.5 Legal notices. WeSpeak does not accept legal notices or service of process related to your booking; such notices must be directed to the Hotel, according to its website policies. WeSpeak only accepts notices related to the Interface at [info@wespeak.pro].
11.6 Scope of responsibility. Any service or assistance provided by the Hotel and/or ZRU is their sole responsibility. WeSpeak does not assume responsibility for such service nor for its outcomes.
